What if your application is rejected? What are reasons for refusal?
Given the number of people who want to move to the United States it will probably not come as a surprise to learn that a large number of applications are rejected. In most cases this will simply because there were better qualified applicants for a limited number of visas. There are however some cases when you may be rejected for a specific reason, if this happens you may be able to have your application reconsidered.
The most likely reason that your application to immigrate to the US would be rejected is that you are simply not qualified. In order to qualify for a green card you need to meet certain criteria and many people don't. In most cases the rejection will occur if you are applying to immigrate through employment, one of two things will happen. The first is that your potential employer may not be able to prove that he looked for an American to do the job and couldn't find one. The other likely reason is that your qualifications are deemed to be inadequate.
The other likely reason that you would be rejected is if you supply incomplete or inaccurate information on your application. It is important that you make sure that you fill in the forms completely and that everything that you include on them is accurate. If you intentionally attempt to mislead the immigration officials you can be pretty sure that they will find out and your application will be rejected. If there was an honest error in filling out the application you may be able to get your application reconsidered, that being said it would be far better if you made sure the information was accurate from the start.
Another reason that you may have your application rejected is if you have a criminal history. The big one here is if you are deemed to be a threat to the United States. This is mainly for people who are involved in terrorist groups. The other thing that will almost certainly get your application rejected is involvement in drug trafficking. If you have a conviction for trafficking drugs there is very little chance that your application will be accepted.
If your application is rejected you do have the right to appeal. This will normally be done in writing but it may require a hearing depending on the reason that you were rejected. If you are appealing because of a mistake that led to the rejection there is a fairly good chance that your appeal will be successful and the application process allowed to continue. If you were rejected for a specific reason you can still appeal but your chances of success will be much lower. In almost all cases you are going to want to have a lawyer to assist you with the appeals process.
